American special education law has developed preliminarily after World WarⅡ. In 1965, the United States promulgated Elementary and Secondary Education Act. It has a very important significance in the history of the United States. It made the federal expand the scope of controlling the education. It also raised the inequality of education of children with disabilities. In 1970, the United States promulgated Education of Handicapped Act. The federal government ensured to provide the educational fund for children with disabilities. In 1973, the United States promulgated Vocational Rehabilitation Act. It provided the legal basis for mainstreaming movement. Since 1975, American special education law developed rapidly. In 1975, The Education for All Handicapped Children Act of 1975 has past. It is the most complete and most important law about the education of children with disabilities in America. This law has greatly promoted the development of American special education. And it is revised in 1986,1990,1997 and 2004. American special education law has influenced the practice of special education.American special education law has integrated with estimated standard. With the social and economic developed, it revised continuously. We can find the constructive elements of the American special education law and use them for conference in the process of Chinese special education law, and expect to improve the perfection of the legislation system in the field of Chinese special education. China should set up an estimated system of special education. Identification and estimation should be put into special education law. It should be adopted the views of parents of children with disabilities during the legislation. China should improve the quality of law. In order to protect the equity of education, the government should enforce the law.
