A Study On The Labor Relationship In The Course Of Reform Of State-owned Enterprises

This text regards reforming system in the state-owned enterprise as the background, has analyzed the labor relationship in the course of selling state-run assets, company amalgamation and bankrupt by policy.This text is divided into three chapters:Chapter one expounds the labor relationship in the course of selling state-run assets. In this part, at first, the author makes an introduction about the labor relationship between enterprise and worker before and after selling the state-run assets. Then analyze the nature, content and form of the country's obligation to worker with "the stock shunt theory" as the foundation. Analyzes the current legislation of our country, and put forward our own suggestion on the weak point.Chapter two expounds the labor relationship in the course of company amalgamation. In this part, the author analyzes two questions mainly: Company amalgamation and the inheriting of labor contract, the company after amalgamating dismisses employees of the company amalgamated .This part compares legislation of a great deal of countries, has analyzed the mode of inheriting by legislation and the mode of inheriting with freedom, and makes an introduction about dismissal. Finally, the author appraises and puts forward suggestion to the relevant labor contracts in the company amalgamates of our country. The important discovery of this part is that have announced two transitions in the legislative mode of our country: The legislation about enterprise annexation has gone through the mode of inheriting by legislation to inheriting with freedom, the legislation about selling assets has gone through the reverse way.Chapter three expounds the labor relationship in the course of bankrupt by policy. In this part, the nature of bankrupt by policy has been defined at first. Then the author analyzes the influence on the labor relationship in the course of bankrupt by policy, among them has analyzed the unfulfilled labor contract and the creditor's rights of workers. Finally, analyzes the policy of our country, and propose our own suggestion on the weak point.
