On The Impact Of WTO's SCM Agreement On Foreign Investment Law Of China And Corresponding Countermeasure

SCM (Subsidies and countervailing measures) agreement is a main international agreement that specially standardized SCM under WTO frame. According to the request of China's entry to WTO protocol, while enjoying the right, the legal system of relevant economy of China should conform with every agreement under WTO frame, defeated by the practical international obligation to fulfill in an all-round way of demand of the protocol with good grounds. As the member of WTO, China comply with SCM agreement becoming reality.In the international economic law field, there has already had argumentation about the impact on international investment law of SCM agreement. The impact of agreement on law of foreign investment of China is a brand-new subject, a lot of problems are worth further investigating. The thesis follows such one train of SCM agreement's impact correctly on international investment, the impact on foreign investment law of China, the suggestions of perfecting foreign investment law of China finally, divided into three parts to prove.First of all, the thesis has started with introducing and evaluating the main content of the agreement, analysed the relation between subsidy and international investment and the impact of agreement on international investment law; Then, the thesis has analysed the influence of the agreement to concrete legal system of foreign investment law of China emphatically, including the positive meaning of the agreement that the agreement produces and the conflict between the foreign investment law of China and the agreement, probed into the government and enterprise should take countermeasures in accordance with SCM agreement afterwards; Finally, the thesis analysed the weak point of the legal system of foreign investment of China in terms of SCM agreement, proposed some suggestions to perfect the foreign investment law of China, made great efforts to make the legal system of foreign investment of China meeting the needs of SCM agreement ,absorb foreign investment and serve for the development of Chinese economy better.
