Comparative Study On Environment Criminal Law

To survive and to develop are the permanent concern for human beings. Since the first industry revolution, science and technology, social productivity have made so great and rapid progress that man has created enormous material wealth than before and the human civilization has achieved a new stage. But at the same time, the giant environmental disaster has also been brought, which may hold back human's progress, even threaten human survival and development. Along with the environment problem daily worsening,how to make full use of criminal law, which is treated a powerful weapon, to prevent, deter and punish environment criminality has become an urgent problem that we are facing. After long-term exploration, in western developed countries, especially those who protect their environment better, criminal law has played an important role in punishing environment crime, and become an important way to solve the environment problem. However, in our country, for many reasons such as lower economy level, later research on environmental crime and so on, the understanding and the research for the theory and the practice of environment criminal law are insufficient. It is obvious that it is urgently needed to strengthen the criminal law in punishing environment crime in order to control the worsening environment problem. Along the mentality, taking criminal crime as the logical beginning, firstly the thesis denotes the concept and the composing elements of criminal crime, and analyzes the history of environmental criminal law briefly. Secondly, it reviews the theory and practice of environment criminal law in typical countries among the two main law systems all over the world, and the methods including comparison analysis and demonstration analysis are applied to analyze them systematically and profoundly. Finally, basing on the analysis of the present environment criminal law in our country, and assimilating and referring the successful practice of foreign countries, the theory of environment criminal law is adjusted, and some concrete measures are also put forward to perfect the environment criminal law in our country.
