Study On The Efficacy Of Law

The efficacy of law is the core issue in jurisprudence, which is focus on the actual situation and effect among the operation of law in modern society of rule by law. Base on the situation of violate the law without bearing burden frequently, it makes clear that researches of law have important oriented pertinence. At the same time, pay more attention about the researches of law have important values in finding origins and enhancing theories, because people have not drown more attention and known clearly. In order to introduce the principal issues of efficacy of law and remark basic situation of efficacy of law in china and explore feasible measures to enhance the efficacy of law ,the author tries to assimilate opinions of other researchers through logical and positive analysis clarifying the efficacy of law. The article includes preface and five chapters.The preface describes the reason, original idea, approach, main contents and arrangement.The first chapter makes readers form a direct and sensible impression through analyzing several true cases and enter into topic of efficacy of law in order to demonstrate its importance, urgency and necessity.The second chapter devotes to define scope and characteristics to precisely clarify concept, resolve disputes and disparity in field of thought.Also deepening people's comprehension of the theme and disclosing significance in both theory and practice basic by distinguishing relevant definitions.The third chapter introduces evaluation standards and methods to construct framework of theoretical analysis, simultaneously, providing operational analytic tool. Firstly, clarify the significance; secondly, narrate the guidance; thirdly, introduce some methods of evaluation; lastly, present internal and external standard.The forth chapter analyzes the present situation applying obtained analysis tool under the guideline of previous theory to demonstrate achievements and weakness. Author intends to show multi-facet elements determining and affecting the efficacy of law. The elements include both internal aspects that lack of legal religious and supreme authority and external aspects including morality, ethics and religious. Therefore, we must take rational measures to effectively improve the efficacy of law.The fifth chapter reminds people neither pessimistic nor optimistic, map out a great landscape, express our indomitable faith and jealous expect of prominent increasing the efficacy of law.
