New Basel Accord And Improvement Of The Legislation About Chinese Banking Supervision

《 International convergence of capital measurement and capitalstandards》 ,which is taken charge of by The Basel Committee On Banking Supervision that is the most authoritative international bank organization in the world, came into the force in 1988. This accord has been called "the sacred treaty" about risk management by the international banking. In January 2001, The Basel Committee On Banking Supervision announced the New Basel Accord. Currently, The draft of the new Accord has already been changed for three times. The new agreement will be taken effect firstly inside those countries which are the members of ten-country-group. And, gradually, this new accord will be put in effect in other countries and district step by step. In the end, it will take place of old accord completely. This will bring about profound influence on global banking. There exists a big margin not only in the idea, technique and method of risking management, but also in the exterior environment of risking management, between the commercial bank in china, the country which is changing its track from the Planned Economy to the Marketing Economy, and the foreign advanced commercial bank. Among that, as the exterior means, legislation about supervision on banking fall far behind the fect. And the stipulation function still got far well exertive. In this thesis, I try to make an analysis on the relationship between the Chinese legislation of supervision on banking and New Basel Accord, and ,by this way, do a study on the partial problems of Chinese legislation of supervision on banking.
