As an important part of the banking regulatory reform, Basel Accord Ⅲ, which provides more stringent international regulatory framework to the global banking sector, has had a profound impact on China’s banking regulatory as well. According to its own development status of the banking sector, on the basis of Basel Accord III China’s banking regulatory authorities has set up a new set of banking regulatory standards, the implementation of which has had significant impact on the development of China’s banking industry, however, in the mean time it has also exposed some problems existing in China’s banking regulatory legal system.In the first part of this paper, the author detailedly introduces the reasons for Basel Accord Ⅲ coming into existence, main content of the Basel Accord Ⅲ and relevant comments, which forms the background of the commencement of the second part. Since the problems which should be solved by the Basel Accord Ⅲ differ from that existing in the development of China’s banking industry, in order to get a better understanding of the influence of Basel Accord Ⅲ to China’s banking regulatory, the second part of the paper mainly studies from two sides:the situation of the implementation of Basel Accord Ⅲ in China and analysis of the impact of China’s new regulatory standard. On the basis of the research done in the second part, the third one largely discusses the problems that appear in the regulatory legal system of China’s banking industry in process of the new regulatory standard implementation. The forth part of the paper provides a few relevant recommendations to solve such problems, hope that would be a reference to improve the regulatory legal system in China’s banking industry.
