On The Expecting Right

The concept of expecting rights is established by the German theory and prejudication , which was still blank in the legislation. For hundred years " there are hundreds of adjudications related to expecting rights, and even more huge collection of the scholar works ." But some fundamental problems such as the concept, the legal nature, essential constituents, the research of types of expecting rights and so on are still in the dispute. With the development of modern civil right research tend to more thoroughly, the development of modern economic, the new transaction type unceasingly appears, which make the academic and economic value of expecting research rights prominent day by day. But expecting rights is neglected or ignored by the civil law and educational fields since long ago in our country. The article based on the social value consideration of anticipated rights research, use the value analysis method to elaborate my own understanding on expecting rights, hoping to provide significant analysis mentality for the expecting rights research.The paper divides into the introduction, four chapters of the main text and the conclusion.The paper introduction part has mainly expounded this thesis research motive, the goal and the significance, and introduce main content of the article.The first chapter of the thesis give out the brief outline of expecting rights, introduce the system background of expecting rights and the theory development; and through the introduction analysis to expecting rights concept of the different viewpoint in educational fields that forms the concept of article to expecting rights, essential constituents and value understanding of the expecting rights, provides the theory premise for the expecting rights question discussion.The second chapter of the thesis discuss the legal nature of expecting rights. The article introduced and analysis the viewpoints of German and Taiwan area and mainland scholars to law nature of expecting rights.
