Treat The Legal Issues Of Green Trade Barrier With The WTO Exception Clause

Due to the reason that the absolute free trade proposed by the World Trade Organization might cause the failed realization of some certain goals in the interior member nations, there exist many exception-clauses which are numerous in amounts, disordered in rules and dispersed in adjusting ranges in the WTO stipulations. Based on the significance in the theory and practice study of the WTO exception clause, this dissertation starts from the analysis of exception-clauses, studies the green trade barrier's origin, the development, the present situation, and the influence, and conceives the consummation of our country green trade barrier system.In the first chapter, the author generally summarizes the background and the reason of WTO exception-clauses'production, and elaborates the green trade barrier theory basis from the exception-clauses'characteristics. Among the multitudinous WTO exception-clauses, the 20th Article of GATT is called the most general exception clause, and the foundations of other exception-clauses. As a result of the exception clause, the existence of the 20th Article of GATT only then gives the excuse of offering the protection towards the country's environment and the zoology and botany health.
