The economic globalization and the trade liberalism make the relationship between economic and environment more close and delicate. While pursuing the maximize economic benefits, people pay attention to the environment problem closely in order to realize "keeping on the development". At the same time, many people use environment problem cunningly as emollient tool to maximize economic benefits. Expecting to succeed in the international competition firmly, they take a series of economic action about environmental protection and build trade barrier. The environment and green barrier have become a focusing problem in the international trade. The developed countries carry out "Green Trade Barrier" in the name of protecting environment in order to limit the products from developing countries and protect their own economic; the "Green Trade Barrier" make developing countries who mainly export "resource intensive type" product face a lot of problems in the way of developing because they consider the external trade as the main motivate to draw the increase of economic. In this situation, it has not only realistic meaning but also relationships with long benefits of developing to think and discuss the environmental barrier problem. Taking "Green Trade Barrier" as the point of departure, essay analyzes the natural, economic, political and legal reason of producing of "Green Trade Barrier" and concludes the basic characteristics and all manifestations system. On the basis of those, the essay elaborates the legal foundation, which "Green Trade Barrier" is depending on. It mainly includes four aspects, which are the green items of GATT and WTO, trade items of regional trade agreements and environmental items of domestic trade law. In the ending, the essay deeply discusses the affective action, which the developing countries use to deal with the "Green Trade Barrier", and points out the urgency of coping with the "Green Trade Barrier" for the developing countries. The author claims that the developing country should participate in the international law-making actively, strengthen international cooperation practically and make full use of solution of WTO in order to change passive to active in making and practicing green trade law. On this foundation the developing countries should continually make the environmental law-making perfect to build domestic green trade law system and enhance environment-protecting law consciousness to advance the development of environment-protecting industry. The government should put more finances to environment and build a high-level research troops who could understand the theories and practices of "Green Trade Barrier" thoroughly in order to find the balance between free trade and protecting environment. In this way, the developing countries could prevent "the economic invade" in the name of green trade from the developed countries and face to the green challenge in the international market by participating the economic international "Game" using the rules that are used widely.
