The Study Of Countermeasures And Conflicts Between The Trade Measures Of MEAs & WTO Trade Rules

The subject of the relation of the multilateral environmental agreement and the rules of WTO was put forward by the EU in 1994,which hope that the trade measures of the MEAs (MEAs including trade measures Whatever be existing or will sign from now on) can be admitted by the WTO. From the Seattle ministerial-level session of 1999 to Doha go-around negotiation, the international society and educational circles have put forward various suggestions in order to clarify and moderated the relations of the MEAs and WTO. But the issue has no result because of conflicts of subject of"environment and the trade"between the developed nations and the developing nations .Currently, the possibility of materiality conflict between the MEAs and trade measure of WTO has become bigger and bigger, but some trade measures protecting environment some nations used for has become a kind of single side , arbitrary and unfair bias means, which will inevitably threat the equity of the international trade .the article will probe into the countermeasures of conflict between MEAs and WTO rules, hoping to solve the problem.The first part of the article introduce the background of conflicts of MEAs and WTO, and put forward that the theory of sustainable development provided a chance to coordinate this conflict.The second part commences from the basic concept, and elaborate the trade measures in the MEAs and the environmental protection items under multilateral trade system, then compared the difference and similarities of them.The third part elaborate the performance of conflict of MEAs and WTO rules ,which includes two aspects:the conflict of MEAs and the basic principle of WTO ;the conflict of MEAs and items of WTO.The forth part and the fifth part are the textual point of this article ,the forth part sum up the suggestions concerning the international society moderating the conflict of them. and analysis the rationality and blemish of these suggestions one by one.
