Research On Some Legal Problems Of Chinese Professional Soccer Transfer System

Transferring means professional soccer players' migration from one soccer club to another soccer club, which means the change of soccer players' labor relationship in essence. Research on the legal problems of Chinese professional soccer transfer system has strong significance for protecting the soccer players' right and interests, promoting the reasonable arrangement of soccer human resource, promoting the progress and legal system building of sports industry. The thesis is mainly about the nature of relationship among soccer players and clubs, the nature of transferring contract, the recognizing of soccer players' right of free transferring and the legal solution of transferring disputes.Firstly, the thesis introduced the history and present situation of Chinese professional soccer transfer system. The soccer transfer system becomes reasonable more and more, but the most serious problem is regarding soccer players as commodities and transferring as trade among soccer clubs. The present transfer system ignored the right of soccer players as human beings and normal laborers.Secondly, the thesis analyzed the legal relationships concerning transferring action. The relationship between soccer players and clubs is relationship of labor contract. Transferring fees should be regarded as not compensation fees but default payment.
