The right to receive education is one of the fundamental rights granted to all citizens by our national constitution. It's also a human right acknowledged by the international community. Education is necessary for one's growth. It plays an important role in the development of society as an equalizer of people in different classes of society. However, in our country, the educational system is no longer serving this function, but now has increased the disparity between people, which makes education itself fall into puzzle. This thesis reflects on the main problems existing in the present educational system. The author attempts to analyze the root causes from a legal point of view. At the same time, she puts forward some solutions and hopes that her work can help mend educational legislation, leading to the improvement of our nation's system of educational law. The author has divided these ideas into four sections, as follows:First of all, the author analyzes the legal right to receive education and explains its essential attributes. Using related legal theories; she redefines this right and uses the new definition to analyze the problems of the education system and the deficiencies educational legislation.Secondly, the author discusses unfair practices in the education system from several different angles and uncovers the legal root behind them. She also makes suggestions about facilitating fairness.Thirdly, the author discusses the difficulties in the theories and practices in the current compulsory educational system, which she believes stem from faults in legislation. By comparing the rights and duties of students in our nation' compulsory education with the rights and duties of students in many western countries, she points out that the operative system's requirements for the student's character are incompatible with the realities of compulsory education. She argues that receiving education is the right of the student. This is different from current theories that hold that education is only a duty, or a combination of duty and right.
