The right to receive education is one of the fundamental rights and was written into the People's Republic of China Constitution. It is an important content to research the state protection of the right to receive education in the educational laws~ field.On the basis of research findings about the right to receive education by precursors, this study has mainly discussed the legality of the state protection of the right to receive education during compulsory education. We adopt historical approach, comparative method, case study method, and analyze related codes and policies during the course of study, and reach some conclusions.There are six parts in this paper. We have mainly clarified the significance, the purposes for the study, key concepts of the research topic, and the present situation of the study and research methods in the foreword part. The first chapter deals with the definition of the right to receive education, and describes the characteristics of compulsory education. Based on these, we conclude the state has the responsibility for citizens to realize their rights. From the second chapter to the fourth chapter we have discussed the achievements on state protection by historical method, and highlight key issues that have emerged from examining the action of legislatures, administrative organs and judicial organs. We have reflected the study in the epilogue part.We come to the conclusion that on the one hand the state has taken many measures in order to realize citizen's right to receive education, on the other hand there are many serious issues during taking action, such as lack of must laws, policies which violate the spirit of Constitution, slack law enforcement and the limitation of scope of accepting cases. It is a long and thorny path to walk on for the state, as it is responsible for ensuring that citizen's rights to receive education obligations are complied with.
