The right to receive education is one of the fundamental rights and was written into the People's Republic of China Constitution. The protection of right to receive the education by the state is an important part of the study of right to receive the education as well as of the education law studies. Lots of studies have been done on the definition, essence, character and content of the right to receive the education, yet few studies have been carried out on the right to receive the education for the disabled children and juveniles.It is well know that compulsory education for the disabled children and juveniles is the weakness of national universal compulsory education. The compulsory education, as country's basic education, is not only the foundation of the education justice but also of the social justice. For the disabled children and juveniles, accepting the compulsory education is key to their development and living. For a nation, it is an important index of civilization and strength.The right to receive the education for the disabled children and juveniles is not only a constitutional right but also prescribed in the related laws. Base on the review of the related studies, compulsory education law and related laws and regulations and files, this thesis, using typical cases as the studying materials, has analyzed the problems in the legal protection of the right to receive the education for the disabled children and juveniles in the compulsory education stage. Some advices have been suggested for these problems.The thesis is composed of five chapters. The first chapter mainly involved the background, clarification of key concepts and review of the present studies and research methods. The second chapter dealt with the definition of the right to receive education, described the characteristics of compulsory education, and discussed the necessity of compulsory education for the disabled children and juveniles. From chapter 3 to chapter 5, we have, from legislation, administrative and judicial aspects, discussed the achievements, current situation and existing problems in state protection of right to receive the education for the disabled children and juveniles in the compulsory education stage. The result showed that on the hand the state has taken many measures to ensure the citizen's right to receive education, on the other hand there are many serious problems during this process such as lack of necessary laws, some policies violating the Constitution, weak law enforcement and the limitation of scope of accepting cases. There is still a long way to go for the state, since it is state's responsibilities to ensure that citizen's rights to receive education are complied with.
