Different from former articles for cloned stress in from family ethics as well as the legal relation between family member angle, this paper is major to study human rights from ethics and legal angle for cloned technology for reproduction .It makes comprehensive analysis, through elaborating the unfavorable influence that clone technology can bring for the aspects such as social ethics, personal rights and legal system. It proves the necessaries of prohibiting the technology of cloned for reproduction.The part of"introduction"of this article is the concept for cloned and introduces the argument towards cloned for reproduction and the necessity of the research.The chapter one analyses for clone technology from ethics, including the four aspects such as the family ethics, social ethics, religious ethics and ethics of science and technology mainly. I thought that the development of clone technology has caused strong impact to social ideology and the viewpoint of value of people , ethics morals idea etc.; The existence of cloned person can make family relation become confusion, it may possibility cause family eventually disintegrate ,it can also cause influence fort he the life and the development of cloned person and prototype person; Personal rights should not conflict with social benefit, the clone technology harms the society serious, therefore it should be prohibit; Clone technology has violated religious doctrine and traditional culture, no matter in eastern or the western , you can not find the existent theoretical basis to it.The chapter two analyses from the angle of human rights and law for clone technology. I think that clone technology not only intruded the right of the embryo ,but also intruded the right of cloned person and prototype person and even that woman, it also makes influence of the dignity of development and the survival of person; Clone technology regards a person as a kind of tool , instead of a person ; Cloning technology can produce a series of negative influence for public benefits; Clone technology can still bring certain impact to current law , which causes legal body confusion.Chapter three introduced the attitude towards clone technology of countries allover the world, as well as the present situation for control of clone technology in world scope. Now, most people opposed cloning for reproduction. There is series of international treaty opposing clone technology, and some countries have even enacted law to prohibit the cloning for reproduction. China has not enacted any law in this field, but it is also trying hard actively.One of the most basic viewpoints of the conclusion is that China should legislate to prohibit clone technology for reproduction, so as to bear the international responsibility and to benefit the mankind. Additionally, for cloning for treatment, the technical rule system should also be very strict.
