Study On The System Of Participants Of China's Legislation Hearing

The system of legislation hearing is a very important legislation procedural system in China, which has been accepted by more and more people. However, there's only few scholars pay attention to the study of the system of the participants of legislation hearing. Beginning with the fundamental theories of the system of the participants of legislation hearing, the article combines the analysis on the practices and the writs of legislation hearing, and aims at researching the existing states of the participants of China's legislation hearing and to put forward the proposals to perfect this system.In Chapter 1, it summarizes and discusses the fundamental theories of the system of the participants of legislation hearing. In Section 1, it analyzes and defines the participants of legislation hearing that's disputed theoretically and practically; In Section 2, it mainly introduces the theoretical basis of the system of the participants of legislation hearing. In addition, it also analyzes the four main theoretical foundations which the system bases on in detail; In Section 3, it tells us the important meaning for setting this system.In Chapter 2, it introduces"the legislation hearing on the standard of reducing the bottom line of paying income tax"which was held couple months ago in detail, including the background of this legislation hearing, the publication of the hearing bulletin, the participants, the hearing procedures and so on, so as to make this system well understood.In Chapter 3, the core of the article, it discusses and analyzes the five major problems (the regulation of the hearing, the choice of the participants, the promoting and regulating system of the participants, the procedures of the participation and the participation of experts) of this system detailedly. Furthermore, it shows us the existing states of the system of participants of China's legislation hearing, and lists the proposals to perfect the system accordingly. In Section 1, it puts forward the problems in the existing system through the analysis on the legislation hearing practice and the related regulations; In Section 2, it emphasizes on providing the solutions accordingly. It can be found through the above analysis as follows:Firstly, the standardization of legislation hearing needs improving. The imperfection of the hearing registrations result in the major existing problems of the system.Secondly, there are many problems should be solved urgently. Such as, the legislation on exit system is absent now; the choice system of hearing participants needs improving; the hearing participants cannot represent all the interests of the related people; the participants'rights and obligations should be regulated further; the system for participants to speak needs revising; the feedback system should be added as soon as possible, etc.Thirdly, for the legislation hearing, it's also an important channel for the related parts with different interests to consult and negotiate with each other. All the interest parts are purposeful to influence the legislation directly and indirectly, which means it's possible to reflect and actualize the participants willing in the legislation at present. Therefore, it's necessary to regulate the legislation hearing systematically and roundly as well as to encourage the public to participate the legislation hearing and to develop the legislation democratization, so as to make sure the system of legislation hearing could play well.
