Studies On Cyber Crime

Currently, the wide use of Internet has promoted the improvement of people's life, however, Internet also have a negative influence on social development. With the rapid development of Internet, the Cyber crime has increased greatly, and more problems about Internet security also have emerged in China. As a special pattern of computer crime, cyber crime has been paid particular attention to in the society. Additionally, because the serious lag of legislation on cyber crime, it is very necessary to research cyber crime carefully in future.This dissertation mainly discusses the definition of cyber crime, constitution of crime, and shortage of legislation, and also gives some suggestions on improvement of relevant law.The first chapter is divided into three sections to gives an overview of cyber crime. Firstly, cyber crime is defined. Nowadays, there are many disputes over computer and cyber crimes in China. After doing some literature review on cyber and computer crimes, the author carefully analyzes different definitions of cyber crime, and gives own ideas according to the character and type of cyber crime. The author suggests that it is not necessary to dispute the definitions of computer and cyber crimes. Moreover, cyber crime should include more explanation. For example, computer crime should be included in cyber crime. Also, cyber crime is committed through computer, Internet, and information technology to harm society severely. The second section presents the varied patterns of cyber crime, such as cyber eroticism, trespass of intellectual property, selling products prohibited by law, fraud, trespass of reputation and privacy, breading into people's Internet, homepage, and mailbox, making or transmitting virus, and cyber gambling, etc. In...
