The Study On The Right Security Of Government Functionaries In China

The purpose of this essay is to give a systematic understanding on right theory from common one to the one of government functionaries by introducing the theory of government functionaries' rights, so as to the necessity of government functionaries' security.Thus, it provides a theoretical basis and a necessity way of thinking on the security of government functionaries in China.Both the"human-oriented"principle and constitution-amending proposed on CPC's important meetings demonstrated that China has noticed the importance of human rights and has embarked on improving citizens' security. But, as a special group of society, whether the rights of government functionaries should be secured became one of the focus issues of authorities. Government Functionaries Law, which began to take effort on Jan 1st ,2006, whose content was amended on many points.However, the rights of government functionaries remain as a significant dominating the Government Functionaries Law. This is the important embodiment of China's principle on valuing and securing human rights under concrete social practice.With the beginning of right theory the essay explores for the theoretical reasons and practical significance of necessity of government functionaries'security analyses the current siyuation and deep-level reasons of government functionaries'security. At last, it was concluded response policy fit for the current situation of China's government functionaries'security.First of all the article outlines the basis theory, bringing in some of scholars'opinions about the conception of right, collecting concerning key-factors, generating the following understanding about the conception of right;being counterpart of obligation, stipulated and secured by Law, giving right owner a kind of formal right;interest or qualification of economy, politic and culture.
