Right is always a key question of jurisprudential study , the same is to the competitive law which is an important sects of economic law , the key content of competitive law is to protect the right of competition . Since the appearance of competitive law , it has been an important field and objective of jurisprudential , and a lot have been achieved in study on competitive law . However , at present , study on the right of competition is imperfect on the whole .The right of competition is the key category of competitive law , and how to define the right of competition is the first question that this thesis must answer . In my opinion , the right of competition is the right that held by the marketer to implement a competitive action or not and to obtain competitive behalf . The reason of advance of the right of competition is the non-orderliness of competitive order and the appearance of competitive law . The nature of the right of competition has some particular character , it is a natural right and a legal right ; and it is a personal right , have the nature of the right of expect and the right of recovery . The right of competition can be classified in many sides , it can be classified into the right of competitive freedom , the right of competitive fairness , and the right of competitive relief . The right of competitive freedom is the right that held by the marketer to implement liberately a competitive action or not and to obtain competitive behalf ; the right of competitive fairness is the right that held by the marketer to implement fairly a competitive action or not and to obtain competitive behalf ; the right of competitive relief is the right to obtain assistance and compensation after infraction , and it is based from the protection of the right of competition .The maintenance of the right of competition is realized mostly by the maintenance of the right of competitive freedom , the right of competitive fairness , and the right of competitive relief . The system of the maintenance of the right of competitive freedom is formed by the antitrust law in the major , and the maintenance of the right of competition was realized by the domination of abuse of dominant...
