Recently with the promotion of international intercourse and economic globalization, international investment presents active state than ever before. On the one hand, developing countries are asked to open their domestic market to developed ones. On the other hand, developing countries actively attract external investment to support domestic construction. But foreign capitals emphasize their own benefit not the host countries'. That usually conflicts with the points of industry policy of the host countries. And because foreign capitals always have strong political background, the hosts are weaker on controlling their action. Those lead the affect of industry policy to weaken. So restricting international investment liberalism by constituting correlative investment laws to make foreign capitals play a positive role as the same time most avoid or reduce the damage of the hosts that has became one of important contents of economic policy every country.To attract foreign capitals always is one of key contents of our reform and opening. And the inflows of a great deal foreign capitals indeed promote the fast development of our economy. Although our country has became the most one on the aspect of quantity of attracting foreign capitals, constituting lows to managing foreign capitals lags to development practice obviously. Especially after our country joining into WTO, we will enlarge zone opened according to rules of WTO. These need us to constitute and perfect the laws and policies of foreign capitals to utilize adequately them.
