Research On The Legal Protective Patterns And Relative Perspectives Of Computer Software

The article is aimed at doing some researches on the responsibilities of computer software protection added up after entering WTO. I try to analyze the suitable legal protective pattern of computer software in the new era in China, and discuss the circumstance problems from the system and practice perspectives, which make the computer software protection in trouble in a long period.While the computer software industry plays a more and more important role in the state economy, the protection of computer software is becoming increasingly important But our present computer software protection pattern as copyright protection as its core cannot follow the pace of the development of times, and also dose not accord with the future international protection pattern of computer software. The article firstly introduces the concept and characteristics of computer software, then compare the different protection patterns, and presents the existing problems of our computer software protection pattern, thus, offer some legislative suggestions. Finally, I forcibly analyze the severe environmental problems of the enforcement of law, and advances that we should improve our environment of the enforcement of law by enhancing the administrative and juridical protection, reinforcing the operation of the computer software industry association, carrying out integrate software governing, so as to provide a system guarantee to make the dream of the right development of our software industry come true.
