Equal opportunity of higher education has two forms which contains comme il faut form and actual form. Comme il faut form means equal opportunity of enrollment and development.But in fact,they are all infracted by unequality of resource and basic pesonality. Thereinto, unequality of resource incorporate difference of different estates,different areas,different nations and different sexes.In a legal visual angle ,we can find that this unequal opportunity may be caused by following factors.Irrational policies and systems, faultiness of legislation, judicature and administration,and thin of subject's right consciousness.So we will perfect it by following suggestions.Firstly,perfect the policies and systems of higher education which contain internal framework of higher education, college's charge policies and student-subsidized policies.Secondly,perfect legislation, judicature and administration about equal opportunity of higher education.And enhance legal protection.Lastly, actualize subjects'right consciousness of educatees,college,judicial department and administrative department.We can construct their consciousness governed by law by popularization, quintessence and error correction.
