The rule of law of the people's livelihood is the inherent requirement of building a country under the rule of law and the rule of law,and also the embodiment of the superiority of the socialist system.Employment is an important area of the rule of law of the people's livelihood,employment related to the legitimate rights and interests of workers and personal income,contribute to the realization of common prosperity.At the same time,equal employment right is the right of citizens to be granted by national law.However,in the process of the current social employment system in our country,many workers and potential workers did not get equal employment opportunities in the process of employment,the employer set artificially some unnecessary restrictions make workers lose equal employment opportunities.With the transformation of the society,the inequality of employment opportunities is becoming more and more serious,and all kinds of employment discrimination are still emerging.At the same time,our country in the protection of employment opportunities in the legal system,legislation,judicial and law enforcement is imperfect,must be resolved.Based on this situation,this paper discusses and studies the legal protection of equality of opportunity in the process of employment.Take the example analysis method,comparative analysis method,literature analysis method,social investigation method,inequality problems existing in our country's current employment opportunities are analyzed and puts forward the legal measures to solve the inequality in employment,equal employment rights protection of workers.The article is divided into three chapters.The first chapter mainly introduces the connotation of equality of opportunity and defines the concept of equal employment opportunity and the historical development of the concept of equal employment opportunity.The second chapter mainly introduces the emergence of employment opportunities equal problems in the development process,adopt empirical analysis method,mainly puts forward the legal dilemma of equal protection of employment legislation and judicial system is not perfect,the government and social organizations did not give full play to the utility.The third chapter mainly introduces the legal protection measures of the equal opportunity in the employment field.Put forward to improve the employment setting,regulation of employer liability autonomy,rational allocation of both the employer and the employee of the burden of proof,the public interest litigation system,strengthen law enforcement and supervision of government departments and give full play to the role of social organizations such as the legal protection of the policy,with a view to the current employment in the field of employment opportunity equal behavior has been curbed.
