A Study On Legal Problem Of The Tort Of Internet Privacy

Internet privacy is the right to privacy in the context of network extension. In the network society, with the development and wider application of network technology, the increasing incidence of invasion of privacy on the Internet, personal privacy is an unprecedented threat, and this hampered the development of the Internet economy. Thus, in the network business environment, more and more countries, particularly developed countries have strengthened the network of privacy infringement problems seriously and have taken appropriate measures. On the China Internet privacy infringement on the theory and relevant research system is still relatively backward, and there is no legislation related to the concept of privacy to network confirmed that the judicial practice is only to violations of their personal interests or general reputation of indirect protection, leading to the emergence of network infringement judicial vacuum. Privacy protection system is facing unprecedented legal challenges. To address the problem in this paper by the author of the first network privacy, network privacy and network privacy interests of a comparative analysis of the theory, thereby infringing on the privacy of the network defined. On this basis, from Europe and the United States and other international legislative experience, combined with our privacy study the actual status of network privacy tort law system more comprehensive ideas and analysis, and from the legal and other relevant channels to create our network privacy protection regime envisaged to achieve a reasonable balance of privacy interest purposes.
