Research On The Organization With Characters Of Chinese Mafia

the criminal organization with the characters of Chinese Mafia, as a special concept in Chinese Criminal Law, has the similar meanings with the word of Mafia in English. However, as a legal term, there are too much criminologists in China believing the word of Chinese Mafia as a loanword from the underworld or underworld society in English. In fact, the word of underworld isn't a legal term in Criminal Law and it only describes a kind of social states of the sub-culture. The author thinks it is very important to admit the word of Chinese Mafia isn't a loanword, because which is a base to research Chinese organized crime. It is only by persisting in this premise, we can educe right conclusions.In this article, author introduced the main two opinions about the question that whether Chinese Mafia is an existent fact in current Chinese society. By analyzing the each opinion, author believes the two opinions are the same on the basic characters of Chinese Mafia. The dissimilarity is which frame of reference the Chinese Mafia is chosen. If we choose the model of foreign gangdom, we should think Mafia hasn't appeared in China, by contrary, we should think Mafia has existed in China. So author used a comparative research on the concepts of own Mafia in Hong Kong, Macao, Taiwan, Japan, Italy and America. As a result, the text got a conclusion: it's different on the concept of Mafia in each country or district.
