A Study On Legislative Model Of Combating AIDS In Our Country

AIDS is popular in Europe and the United States mainland in 1980s. With in-depth understanding of AIDS, all sectors of society has reached a consensus on the problem of controlling AIDS with legal means. However, the different legal concepts may produce different legislative model. The legislative model of difference has again decided the role that law can play in the AIDS prevention work. This article is focused on the two models of the AIDS legislation: the punishment legislative model and the protective legislative model. By the comparison of the legislative models in the basic concepts, laws and regulations as well as the role playing in the AIDS prevention work, we attempt to give some recommendation in the legislation.It is divided into five chapters. Because of the closely relationship between legislation of the AIDS and its biological characteristics, we briefly introduced the biology of AIDS, the current AIDS epidemic and the impact of AIDS on society in the first. In the second chapter, the authors focused on the ethical standards of AIDS legislation. Ethical standards in the health system is an important reference during the legislative process . In this chapter, the author described the ethical principles and the ethical standards in the legislation on combating AIDS. The third chapter described the legislative patterns in detail. In this chapter, the author briefly introduced the legislative patterns first.
