Informal Employment is a brand new form of employment which has strong forward-looking and practical significance to society and individuals. Compared with Formal Employment, Informal Employment is mobile and flexible, and has the advantage that it has broad employment field and low employment access. So Informal Employment gains the growing worldwide attention.We have to consider the function of Informal Employment to alleviate the enormous social pressure because of China's huge size of the labor force, as well as the emerging of hidden unemployment problems caused by transformation of system since the beginning of reform and opening up policy. Since the International Labor Organization (ILO) presented the term of Informal Employment, many economists and sociologists have made many useful researches on Informal Employment from the social backgrounds of their own countries. Unfortunately in China the theory about Informal Employment is not perfect and systematic, particularly none of the scholars made researches from the perspective of law science. There are even numerous disputes about how to define Informal Employment.The uncertainty of intension and extension of Informal employment has led to the disunity and even internal conflicts of laws, regulations and related policies.
