The Analysis And Investigation Of The Chinese XinFang System

As one of the most basic public opinion expression systems in China, XinFang system which has Chinese characteristic is the important channel which ties up public and government. In the past fifty years, XinFang system has a very important role such as expressing the public opinion, vindicating public legal rights, reducing public interior conflicts, actualizing democracy supervision.Nowadays, with the developing of the Chinese reform, different kinds of public interior conflicts increasingly appeared. XinFang system which is as the weatherglass of reflecting the conflicts appears a great deal of new complexions and questions now. We must pay more attention to these questions. Now the contradictions of XinFang shows different characteristics: First, the principal part of XinFang becomes more universality and the scale of XinFang becomes collection. Second, the questions of XinFang become more complexity and the contents of these questions become relatively convergence. Third, the activities of XinFang are organized secretly and the antagonism of these activities become more strong. Forth, the selectivity of activities become more evidence, especially at time and places.Therefore, administrational XinFang faces a lot of problems now. First, the institution of XinFang will deal with many conflicts which are not part of his functions. Second, the body of dispelling the conflicts is not definitude. Third, lots of conflicts which are difficulty to deal with disturb the daily grind of administrational departments. Forth, a great deal of repeating XinFang increase the hardship of the work of government.There are different reasons which induce these problems, including impersonality reasons, personality reasons, policy reasons and so on. First, the channel of XinFang is not smooth. Second, the aim of the administrational department of XinFang is not clear. Third, the function of the administrational department of XinFang is illogical. Forth, the orientation of the institution of XinFang is ambiguity. Fifth, the supervision of XinFang work is not strong. Sixth, the duty running mechanism of XinFang is not existing. Seventh, the final mechanism of XinFang is distempered. The rules and laws of XinFang is faulty.Aiming at these above problems, my disquisition first handle the research measure which integrates some different subjects to excavate the five academic thereunders in order to consummate the Chinese administrative XinFang system. That is constitution thereunder, dialectic relation between the economic base and superstructure, thereunder of the people's interior contradiction, thereunder of the mass route and thereunder of the Safety valve theory.Second, my disquisition use the comparative analysis way to get the advantages of the Ombudsman using in European.
