Study On The Legal Mechanism Of Natural Heritage Preservation In China

Natural heritage is irreproducible precious wealth formed in the process of earth evolvement. Human has done tremendous efforts to protect them. Especially, after the birth of Convention Concerning the Protection of the World Cultural and Natural Heritage in 1975, the international community takes action in lawmaking works on natural heritage protection that formed a wave of natural heritage protection in the global scope. Since 1985 in which China granted the Convention Concerning the Protection of the World Cultural and Natural Heritage, the achievement in the protection of natural heritage in our country is remarkable. But lawmaking works related with the protection of natural heritage is behindhand. Therefore, this paper aims at the research on legal mechanism of natural heritage preservation. From the basic concept of natural heritage, this paper put forward the basic path and system design on setting up legal mechanism of natural heritage preservation in order to provide certain theories reference and basis for the lawmaking of natural heritage preservation and for the establishment of good faith of natural heritage preservation. This paper reviewed the history and international law sources of natural heritage preservation. By the emphasis that domestic environmental law should moderates with international environment law, this paper also analyzed the present situation of laws on natural heritage preservation in our country.The article is divided into six chapters:Chapter 1, general summary of natural heritage and its legal mechanism. By using theories analysis, comparative analysis etc., definite the basic concept of the natural heritage and the law mechanism delicately and deeply, and carry on an analysis to the relation of natural heritage and legal mechanism.Chapter 2, the history of natural heritage preservation. By reviewing the development of natural heritage preservation to open out the historic foundation of legal mechanism on natural heritage preservation.Chapter 3, the international legal sources of natural heritage preservation.
