Establishment Of Community Correction System Of Minor Criminal

During the transmission period of the society of our country, the minor criminal shows its frequent occurrence and a series of other specialties. The minor criminal has also become a serious global social problem which urgently needs solution. The traditional prevention and correction method of the criminal minors in our country is now facing severe challenges and may not be functioning well. The social correction is an effective correction of minor criminal which is widely adopted in various countries in the world. In China, we have just started in this area. The minor criminals are very different from and have their own specialties comparing to the adult criminals in terms of psychology, biology and knowledge and sense. Therefore, the social correction of minor criminals shall not only have the common nature of social correction, but also have its specialties which are different from the social correction for adult criminals. As a brand new social juries work, we do not have proper social correction administration system suitable for minor criminals. Theoretically and practically, the scholiasts and the actual practicing authorities have no knowledge on the nature of social correction for minor criminal, the confirmation on the target of such correction and on the establishment of correction model (including the subject of correction, correction items and correction method). The operation of minor criminal social correction together with that of adult criminal without separation leads to the low quality of correction and also impact the effectiveness of social correction. Therefore, it is necessary to establish the social correction system for minor criminal with the Chinese local specialties to meet the special psychological and biological requirements of minor criminals.As a preliminary research, this dissertation has analyzed based on the criminology, sociology, jurisdiction administration and social working science etc. This dissertationhas further adopted the methodology of comparison investigation and actual research investigation. It has first analyzed the necessity and urgency of adopting the social correction for minor criminals and then analyzed the shortcomings of the current correction model and methods. With the reference to the theories and actual experience in the social correction system of minor criminal adopted in abroad and Hong Kong and Macau areas, together based on the summarization of the social correction methods for minor criminals currently adopted in Shanghai and Beijing, it has proposed some social correction system for minor criminal which may be suitable for our country and also proposed some new points, including the improvement of correction subject, correction item and creativity of correction method. It has finally made some legislation proposals based on the actual working experience.
