Researches On Community Corrections

In July ,2003, the Supreme People's Court, the Supreme People's Procurator the Ministry of Public Security, Ministry of Justice enacted The Notice About Launching the Experimental Work Of Community Correction determining Beijing, Tianjin, Shanghai, Jiangsu, Zhejiang, Shandong as tentative district all over the country. Compared with imprisonment, community correction is one kind of socialized and none-imprisonment execution, which means that the special institutions correct the crimes' psychological abuse and disbehavior and make them successfully Return to society with the help and assistance of fork organization related and volunteers.The community correction originated from western countries in 1940s .in terms of legislative aspect, trialing aspect and executing aspect, They constructed comparatively complete system.. The community correction of our country stemed from the system 'went back to the village to execute'in 2050s, and achieved much.. After decades of development, the community correction made certain achievement, in maintaining order, ensuring human rights and constructing modernized legal system. Comparatively speaking, it is still a kind of new system, which has defect more or less, for instance, lack in legislation, incomplete about relevant measurement in judicature, inconsistence in administration. The socialization measure of execution has become an inevitable trend of modern penalty, in order to adapt to the penalty development trend of the world, constructing complete and rational system of community correction is imperative. However, complacent and conservative manner is not the option in design a legal system , but systematic and dynamic thought. Professor Chu huaizhi put forward integrated thought of criminal science which offers the theoretical foundation and reference for design and studying of the legal system.
