Study On The Construction Of The Separated Management Correction System In Juvenile Community Correction

General Secretary Xi pointed out that building a socialist legal system with Chinese characteristics is the overall goal of promoting the rule of law in an all-round way.This general aim is to make clear that the law and regulations should be perfected continuously,and that the crime of underage is high-prone and serious and complex problem.Therefore,we should also pay attention to the perfecting and development of the legal system for protecting underage.Crime minors bring danger to society,cause personal and property damage to the victims,and deserve punishment and education.There is a tradition of respecting the old and caring for the young,paying attention to the protection and growth of the children,and the minors are the future of the country.They cannot ignore the guarantee of human rights while punishing the minors.The offender is correctly corrected and guided.The community correction penalty system is suitable for the physical and mental development of juvenile offenders because of its non-prisonment and humanitarian concern.It not only prevents the "second damage" caused by the label of "criminal" to juvenile delinquents,but also avoids the "cross-infection" of prison service mode,which prevents the criminal minors from re-crime so that they can socialize smoothly and return to society.Since 2002,the Office of the CPC Subcommittee on Prevention and Control of Juvenile Delinquency has put forward a plan to pay attention to community correction and develop a "Community Prevention Plan for Young Offenders".The political and legal departments at all levels have made great efforts to explore,work departments and the active attention of university students,and the construction of community correction inour country has achieved remarkable results.But the time when the community correction system was in the bud.In the late period,the lack of targeted corrective measures and systematic legislation on juvenile community correction showed that the formal community correction law was promulgated but not yet implemented,and the relevant laws and regulations were scattered and operationally weak.The community correction sub-tube is divided into two groups: the community correction personnel are separately managed separately,and the community correction personnel are corrected separately.First,minors are young,physically and mentally immature,weak in judgment,impulsive,and sensitive to misjudgment,which make them separate from criminal adults when performing community correction.In addition,in practice,Individual differences among correction objects in the community,and different correction objects in the underage community have different problems,such as mental illness,personality characteristics,ability size,crime type,etc.Therefore,the goal of community correction is to classify the correction object according to the characteristics of the correction object in the underage community and adopt the corrective action.The first chapter of this paper shows the theory and practical significance of community correction for minors,as well as the research methods used in this paper.Chapter two gives a brief description of the basic content of the correction and subdivision of juvenile community,gives a literature review and analysis on the theoretical research and practical development respectively,and introduces the correction characteristics of some areas in China and the correction system of juvenile community in China.The shortcomings of sub-tube correction in implementation and the value of sub-tube correction in minors' community.Chapter three draws on the beneficial experience suitable for the development of China's decentralization by studying the model of community correction in several typical countries.Chapter four mainly analyses the feasibility of improving the system of correction of sub-tube separation in the community of minors in our country.Chapter five puts forward the view on the construction of the sub-tube system under the correction system for minors in China,and expresses the comprehensive and in-depth understanding of the problem.
