Research On Training Contract

In the knowledge economic society nowadays, training has become an important part of people's life. But the law framework about training contracts is still seriously delayed. In academic circles, research concerning training contracts is too weak to provide potent theoretical supports for legislation and judicature.Based on principles of contract law and combined with typical cases of training contracts, this thesis researches into relevant legal problems of training contracts from theoretical and practical points of view. It is divided into four chapters besides introduction and conclusion.Chapter One is an outline of training contracts. Staring with the definition, the characteristic and the classification ,this chapter defines the training contracts and makes clear the relations between some closing legal concept and the training contract.Chapter Two researches on the some problems of training contract's subject. This part defines the main factors about the legal relationship of training contracts by analyzing the requirements for qualification of training facilities, telling how to sign a training contract when a nonage acts as a trainee, and elucidating the effect on the third people in the training contract for the third one's benefits.Chapter Three focus on notice in signing training contracts. This chapter expounds some problems should be noticed while signing training contracts by studying on some typical cases in our life.Chapter Four expatiates the modification or rescission of training contracts and its legal consequence. Staring with modification of the legal relationship of training contracts, and combining with typical cases, this part researches on the legal facts and its legal consequence about the modification of the training contract .Through analyzing on some legal problems of training contracts above, this thesis does its best to enrich the theory and promote the legislation of training contracts in the future. It also hopes its process of the study may stimulate and do good to the other unnamed contracts.
