After the approval of United Nations Convention against Corruption by Standing Committee of the National People's Congress, how to understand, borrow ideas from and absorb relevant contents, and comparing status quo of China's legal system of criminal justice, timely adjust penal law and criminal law of our country, so as to make China's legal system of criminal justice coordinate with certain prescriptions of United Nations Convention against Corruption, are main problems judicial department is facing. This paper starts with the contents of United Nations Convention against Corruption, and present status of legislation against corruption in our country. How to join the penal law and criminal law of our country to United Nations Convention against Corruption, and how to perfect the former are analyzed through comparison.This paper first expounds the background of United Nations Convention against Corruption, and its five legal mechanisms established for anti-corruption, especially the creative one—prevention mechanism. The main body of the paper analyses in detail the specific prescriptions of United Nations Convention against Corruption, and combining our national conditions and depending on present status of legislation against corruption, makes suggestions on legislation of legal system of criminal justice in respect of anti-corruption prevention and punishment. The purpose is to establish a more perfect legal system of criminal justice that is in accordance with our national conditions, on the basis of a full understanding of the principle and essence of United Nations Convention against Corruption, and by solving the existing diversities.
