Constitutional Thoughts Of Zhang Shizhao

Zhang Shizhao is a famous political commenter and social celebrity in modern Chinese history. He experienced three dissimilar historical ages, including last years of Qing Dynasty, Zhonghua Minguo, and the P.R.C.. He played as many social parts, such as journalist, schoolmaster, official, scholar, lawyer, and engaged in revolution campaign. For he was influenced deeply by western constitution doctrine when he studied aboard, his spread, assumption and reflection on western constitution doctrine was almost in the same phase with appearance and development of Chinese constitution exploration in recent age. He is a representative of active intellectuals in political circles and press circles in his age. This thesis discusses the development course of his constitution doctrine through research on his political comment from last years of Qing Dynasty to early years of Zhonghua Minguo.This thesis is composed of three parts. Preface introduces Zhang Shizhao's life, his doctrinal development course and defines the research range of this thesis.First Chapter mainly introduces the background in which Zhang Shizhao developed his constitution doctrine. It explores that both Chinese traditional culture and western political doctrine had effects on his doctrine. And it refers his revolutionary experience in protest to Man nation, in which his constitution doctrine began to germinate.Second Chapter discusses essential content of Zhang Shizhao's constitution doctrine. It expounds his constitution government doctrine, party government doctrine, freedom right doctrine, judicial equality doctrine, etc.. It seeks for a comparative clear thread through a review of his numerous political comments, in order to give a clear description on his constitution doctrine.Third chapter summarizes characteristics of Zhang Shizhao's constitution doctrine and comments on his constitution doctrine. His constitution doctrine has its advancement meaning and its historical limitation.It is expected that the paper would provide some related information for reference when the construction of our nation's constitutional law thought is under the research and analysis.
