Shizhao In Minli "period Of Constitutional Thought Study

Zhang Shizhao was a famous politician in the Modern and Contemporary History of China. He studied in the England in the early years. In the end of Qing Dynasty and the early Republican, he published lots of articles about political comment. There are so many constitutional thoughts in his political comment articles. His thoughts have great influence in the field of constitutional thoughts. Because he read lots of Western constitutionalism original when he studied in the England, and he did well in logic, so his constitutional thoughts has vivid personal characteristics, compared with other people in the same times. This paper simply investigated Zhang Shizhao's constitution thoughts in the period of Minli bao. Minli bao was a mainly carrier, which was an important lace that Zhang Shizhao can say ideas in.This paper is composed of four arts. Chapter one was introduced Zhang Shizhao's background of constitution thoughts in Minli bao.It contains Zhang Shizhao's experience of constitution thoughts before Minli bao, the relationship between Zhang Shizhao and Minli bao, and the constitutional status of Minli bao. Chapter two analyzed the historical original of Zhang Shizhao's constitution thoughts. It mainly contains the Chinese traditional culture of concept of equality and western political thought. Chapter three mainly introduced the contents of Zhang Shizhao's constitution thoughts. This chapter is the main content of the paper. Zhang Shizhao's thought contains constitutional theory and regime theory. I am analyzed three arts in constitutional theory:constitutional thought, the "Provisional Constitution" comments and autocracy. First, the constitution.Zhang Shizhao considered Chinese constitution into unwritten constitution and flexible constitution. Second, analyzed the "Provisional Constitution", he believed "Provisional Constitution" had reasonable but not a very good bill. "Provisional Constitution" did not set how to fulfill the people's right. Last, he analyzed autocracy problem. He believed people's freedom and happiness came from clear and bright politics, but the clear need to strictly enforce the law as a political guarantee. Only ruling of law, people can make happy. In regime theory, I mainly talked about three contents. First, advocate a unicameral, bicameral position. Second, against the residential system, suggested that the cabinet system. Third, advocating politics arty and destructing of the arty. Chapter four talked about the evaluate of Zhang Shizhao's constitution thoughts. Analyzed the trait, meaning and limitations of Zhang Shizhao's constitution thoughts.
