A Study On The Legal Regulation Of Coal Mine Production Safety

In our country , all kinds of accidents happened frequently during the coal mine production .From 2001 to 2005,there were 18518 cases happened all over the country ,at least 31064 dead .About 3702 various incidents happened every year on average ,died about 6213,which is far higher than the world average level. The harsh condition of safe producing not only threats the safety and health of public's life , but also affects the social stability, harmony and international image.People with insight from all kinds of fields analyze and study the phenomenon from different angle ,and have put forward many useful viewpoints. For my view , the legal regulation is the best choice to resolve the safe problem of the coal mine produces.The accidents occurred in the coal mine producing took effect in many aspects, the key feature is its infringing people's living right and undermining social order. However , the two aspects are the prominent protective target in domestic countries. In other word , effective laws should be made to confine the occurrence of these terrible accidents proper.Taking constitution into account it is a common understanding that the government 's standardizing the social economical activities are constitutional right ,even America who owed the highest liberalizing degree affirmed this by putting constitutional cases on file .Secondly ,in the constitution ,as living right is the most valuable one ,it is necessary a constitutional country to make laws to protect it .In the stipulation theories ,owing to the existence of the externalatics and social asymmetric, government should do something to confine the economical activities in certain area to avoid the disadvantages brought in by externalatics and social asymmetric,so that we could reach pareto efficiency. However, coal mine producing and the occurrence of those accidents have these stated features. In this way ,it is necessary for the country offer social public object by making laws .According to the law ,no matter analytical legal vision or natural legal parts ,order is the most valuable goal in the law in any period .Accidents in coal mines are just doing harm to the social order .At the same time , justice ,as the embodiment of law ,it goes without saying its value. While the workers' living right is threaten by the realization of the coal mine lords' fortune ,we can not gain justice anymore.
