Study On Chinese Legal System For Coal Mine Safety Production

China is a country with coal as its main energy. The coal industry is an important component of the national economy. Mine production safety situation has a direct bearing on the people's lives and property and the country's international image. Because of the wide distribution of our country's coal resources, large quantity of the exploitation and demand, it is particularly different in the ways of production, management and protection. And with the development of the times and the deepening of reform, the issue of production safety in coal mines becomes increasingly prominent by the frequent occurrence of coal mine accidents which are caused by many factors. In addition to the technology, low level of the security, serious gas disasters such objective factors, there are also subjective ones such as lack of security sense and safety monitoring and unclear responsibilities of the enterprises body. From the analysis of legal issues, we can find such main reasons as following which are responsible for it: the power of the production safety management system has not been set up properly; the existing legal system is not sound enough; many important legal systems have not been established yet. Making a general survey of the international situation, we can find almost all the major coal-producing countries have set a management system suited to their own countries, many of which are worth learning for our country's good.This paper is based on the current situation of China's coal mine production safety, for the purpose of exploring the objective reasons as well as the legal issues of the frequent safety accidents in our country's coal mines. At the same time, it is also based on the existing legal system of our coal mine safety production, trying to analyze the problems that need urgent solution in our current legal system. This paper thoroughly studied the particular defects of China's current coal mine safety legal system; clearly expounded the specific measures in improving the legal system of our current coal mine safety production on the basis of a mature legal system of the developed countries and proposed the concrete ideas to establish a new legal system of the safety production in coal mines.
