A Study On Legal Rights And Contract Rights Of Seaman

The navigation is a special occupation, the seaman is a special community. The benefits of the seaman needs special protection.However, the laws and regulations binding seaman's employment aren't sufficient in China,so the benefits of seaman can't be well protected. This paper tries to analyze the realization of legal rights of the seaman in the angle of the jurisprudencenomology,and from this point.digusses the protection of seaman contract right in China.First,this paper analyzes the reason of special protection of benefits of seaman.There's great differences of work environment between land and sea.Such differences leads the seaman have special request on wage,work condition,damage indemnification, particularity of benefits of seaman,and special protection on this partticularity.then,this paper disgusses the sorts of rights and relationship between them in angle of the jurisprudencenomology,and analyzes the cindition of seaman get conclusion of that the contract of seamen's employment is the way threw what the legal rights turn into actually right of seaman.Since we have the conclution of that,it is not hard for us to find that the standardization of contract of seamen's employment is important to protection of benefits of the seaman.so this paper make deep disgussion in character ,process of conclution, concrete content of contract of seamen's employment,with consult of expercences of foreign country and concrete condition of China.the seaman on overseas employment is a special colony,conmonly,they aren't ajusted by the Chinese law of seaman employment,however,their rights may influenced by our system of overseas employment,so this problem is disgussed in this paper.finnally,author make an advise on Chinese law of seaman employment,and it is useful to protection of seaman's right.
