Research On Legal System Of Exporting Product Liability Insurance

With the acceleration of the global economic integration, worldwide product exchange is more and more popular. As one system is of great benefit to producers and sellers who will to be liable for damage to customers because their product is do harm to consumers because of product defect, the exporting product liability insurance, is more important today. But many Chinese producers are not very familiar with this insurance system when they export their products to developed country, so they can not develop their business efficiently in the countries. At the same time, many foreign insurance companies develop their product liability insurance business in China market rapidly because most domestic insurance companies are lack of knowledge and experience in this field.The paper is totally divided into five parts. Part one is the outline of product liability insurance system. Then the author talks of legal problems of product liability. The third part is legal research of exporting product liability insurance laws. At the following part relative problems of exporting product liability insurance contract are concerned. The fifth part is some legislation suggestions and mends in the policy of PICC P&C. Totally, the author points out that at present some problems still exist in the field of exporter product liability insurance, one is the conflicts of product liability laws, the other is the conflicts of product liability insurance contract laws.Part one: The author defines the exporter product liability insurance, and explains the characters of this insurance. At the end of this part, there is the legal outline of exporting product liability insurance system.Part Two: Author first define product and its defect, and then tell us the development of principle of imputation in the product liability law. Also the author talks of conflicts of product liability laws.Part Three: From the view of comparative law, the author discusses insurance law allover the world.Part Four: The author first talks of his point: Principles of utmost good faith, insurance interest and compensation of damage should be the basis of validity for product liability insurance contract. Then the author gives basic terms of product liability insurance contract according to the insurance law and insurance clauses from UK. At the last the author points out that at present some conflicts exist in liability insurance contract laws.Part Five: the author gives some advice to perfect the product liability insurance system.
