The Sociological Analysis Of China's Duty Crime In The Trsition Period

The problem of Duty crimes is always a chronic disease puzzling the various countries' governments and the societies. Specially for China, a socialist country that is still at the preliminary modernized stage, the problem of Duty crimes has been a big problem connected with our Party's being in power foundation, the stable political power, the social stability and the will of the people. The serious duty corrupt crime phenomenon not only has harmed the national and people's basic interest seriously, but destroyed the healthy development of our Socialist Market Economy, moreover has brought the extremely bad social influence for the mind image and the status of our Party and government in the people's heart. Therefore, the multitudinous scholars have separately launched the thorough research and the discussion from different discipline angles to the duty crime question.In this article, I tried another method, taking the sociological correlation theories as the foundation, and experimentally carry on some researches on these particular aspects such as the present situation of social development, social reason from the sociological angle of view to the Duty crimes in our countries' transition period. And here I have proposed a series of measure for "social prevent and control strategy". And I hope that such research can bring certain good function to our controlling and solving for Duty crimes on the present age.According to this article, besides the introduction and the conclusion parts, I have divided this article into four chapters:The first chapter is "The Duty crimes in the sociological vision". The article first reviewed the sociology theory about crime such as these basic concepts: "The theory that society deviates from the norm", "The theory of different contact", "The theory of cultural conflict", "The theory of social control" and so on; then I made a recollection to the foreign and Chinese scholars' research history about the Duty crime, and introduced the Chinese scholars' researches since Republic of China to today on the Duty crime from the sociological angle of view in details; finally, I made the basic conception limits to the Chinese duty crime sociology research theory system from the sociological angle, and proposed a series of restructures on rebuilding this theory system, and I also elaborated specifically these following questions, such as "The necessities and the requests of restructuring our country's Duty crime sociology research theory system", "The Duty crime in the strictly sociological angle of view", "The types of Duty crime which decides from the sociological vision", and so on.The second chapter is "The present inspection on Duty crime of China society in it's transition period situation". As the name suggests, this part is mainly about some appraisals and the analysis on Duty crime of China society in its transition period situation from the reality angle. First, the article demonstrated the social reforming background where Duty crime of China society occurs. Third, I specially paid attention to some hot spots of society by the special form, like "26, 29 phenomena", and "49, 59 phenomena", "The phenomenon of corrupt officials escaping abroad".The third chapter is "The sociological analysis of the social reasons of China's Duty crime in transition period". This is one of the key parts of this article. The premise of solving a social question is to analyze the reasons for its production. So here I mainly analyzed the social reasons of which caused China's Duty crime from the sociological angle. And I elaborated specifically the relations between China's Duty crime in the transition period and those aspects like "The social group", "The social vicissitude", "The social culture".The fourth chapter is "The social control for China's Duty crime in transition period." It is the most important part in the article. We inspect the social question, analyze its reasons, but finally must stop over at the strategy and measures to solve the question. In this chapter, first, I briefly analyzed and summarized the movement tendency and the rules of China' duty crime in the transition period; then, I attempted to use the theory of "Social control" to elaborate emphatically from the sociological angle of view how could we consummate our social control system for controlling the Duty crimes; and then I mainly analyzed the principles from the theory stratification we should stick to in formulating the strategies and the measures to prevent and control the Duty crimes in China's transition period. For example, "The perfect union between positive control and negative control", "Strengthening the soft control to lead the hard control", "The construction of 'The three cascade social control network'", and so on; finally, depending on "The theory of social safety valve"—one opinion of "Theory of Social Conflict", I specially proposed establishing the social safety valve system to control and prevent China's duty crime in the transition period. And the main measures are that: "Building the Chinese characteristic public official social security system", "The construction of all kinds of public officials expression mechanism" and so on.
