On The Legal Status Of Owners'Association

The paper focuses on the legal status of the owners'association. The author abstracts the legal person's system inside and outside of china, and divides it into 2 parts: (1) substantial elements of capacity of civil conduct and capacity for liability;(2) formal elements, the registration for purpose of public notice. Under the structure of analysis, the author tries to discuss the legal personality of the owners'association by comparative method, law interpretation, history analysis and so on. Then the author concludes that owner'association satisfies all the essential elements of a legal person. However, the formal elements need to be improved during the lawmaking process. In the end, the author analyses the legal status of owners'association'in litigation.
