It is an obvious fact that the economic globalization impacts labor's right a lot. The problems of labor's right become more and more complicated after the appearance of a series of new labor's movement especially, such as the anti-globalization movement and the anti-sweatshop movement. But for a lot of causes, there is little deep attention and research on this question both in our country and abroad. The author has a try to make deeper analysis to the protection of labor's right in the background of globalization. The full text is totally divided into four parts.In the first part, the question proposed and the frame of the argument established. In this part, the author introduces briefly the status of the protection of labor's right in the background of globalization and the significance of the paper. And then, the author mainly expounds the question proposed and the frame of the argument established. And the author derives the conclusion that the core contradiction is the contradiction between different countries' insists about labor's right and international labor standards, which is in the contradiction groups which exist in the new relationship between labors and capitalists in the background of globalization. And the author also researches the premise of international labor standards which cause a lot of contradictions.In the second part, introduction and coordination of the problems in the protection of labor's right in the background of globalization. This part of elaboration is very necessary to carry on writing this paper. Firstly, the author introduces the status of labor's movements in the world. In order to make the discussion clearer, the author limits the signification of labor's movement in this paper, which not only includes the traditional labor's movement, but also includes the part of anti-globalization movement which leaded by the labor organizations and the anti-sweatshop movement which leaded by some NGO(Non-government Organization),such as labor organizations, students, religious organization, etc. And the author compares the labor's movements in the background of globalization and the traditional labor's movement. Secondly, the author expounds the situation of the world labors recently in order to show that the living status of labors in the background of globalization doesn't become better than before and in fact it is becoming worse and worse.In the third part, the author analyses the contradiction groups hiding in the new relationship between labors and capitalists. It can be seen from the status of labor's movements in the world and the situation of the world labors in nowadays that globalization derives a new relationship between labors and capitalists. It can be proved by characteristics and subjects. Corresponding, there are a lot of differences between the contradictions in the new relationship between labors and capitalists and the traditional relationship between labors and capitalists. The new relationship between labors and capitalists not only includes the traditional contradictions, but also includes other contradictions. And these contradictions are interleaving each other and form a contradiction group. In this part, the author analyses the contradiction group step by step. Besides the traditional contradiction between labors and capitalists, the contradiction group includes the contradiction between western countries and the third world countries. The contradiction between western countries and the third world countries can be fractionized into some contradictions, such as the contradiction between capitalists in the western countries and governments in the third countries, the contradiction between capitalists in the western countries and labors in the third countries, the contradiction between labors in the western countries and labors in the third countries, etc. Generally, in the author's opinion, besides the traditional contradiction between labors and capitalists, the contradiction group can mainly divides into two contradictions, the contradiction between different insists on the protection of labor's right which is brought forward by developed countries and developing countries and the contradiction between each country's opinion of their own rights and international labor standards. On the basic of this, the author deduces the conclusion that the core contradiction is the contradiction between each country's opinion of their own rights and international labor standards by the method of comparing and analyzing.It can be seen from the statement in the third part that each kind of contradiction in the new contradiction groups finally point to the international labor standards. Today almost everyone has a piece of consistent idea that the international labor standards have no way to solve the problem of the protection of labor's right. Reversely, the international labor standards are becoming new traffic obstruction, which are used by developed countries. It derives a more complicated question, that is, why does every part still stick up for the rule even though the rule can not solve the problem of the protection of labor's right? There is a more important question, that is, what is the existing premise of the international labor standards? The author explores and analyses this question in the fourth part.In the fourth part, the author analyses the existing premise of the international labor standards .The international labor standards have the power of inhibition which is becoming stronger and stronger with the advance of globalization. The advance of globalization results in disproportion between the circulation of capital and the circulation of labor. Each country has its own idea. During the problem becoming more obvious, the emergence of international labor standards accelerates the form of compromise between different countries on some material questions. But it must result more problems which are caused by using the same standard to solve them. The article expounds so many problems involved by international labor standards. Thus it can be seen the answer to what is the existing premise of the international labor standards is very important to analyze the problem of the protection of labor' right. The author analyses the general situation and development situation and educes the conclusion that the premise is globalization.
