Study On The Mechanism Of Benign Interaction Between The Justice And The Media

In recent years, the relationship between the justice and the media caused extensive concern of the academic circles. The scholars interpreted it from different angles of view, which is profuse and confusing. The author combs different standpoints, and represents the actualities of relationship between the justice and the media .Then analyzes the various causes of conflict of them. The author also states that we shall realize benign interaction between the justice and the media.The whole thesis is divided into six parts, from preface to the ending part, as follows,In the preface, the author introduces the main purpose to write this thesis and points out the key issue the author wants to resolve. Then the author begins with the case of"Yanping Jiang"and mentions the problem, how to deal with the relationship between the justice and the media. Next is the first chapter. In this part, the author introduces concepts and social functions of the justice and the media , and compares their characters to pave the following parts. Then represents the actualities of relationship between the justice and the media and analyzes the causes of conflict of them, such as the media's irresponsible reports, the justice's weak anti-jamming ability, the differences between them and conflict of the values. In the second chapter, the author recounts the related rules and practice of Britain, America and other continental legal system countries in order to provide valuable experience for our solution to the conflict of the justice and the media .We shall protect the freedom of the press , at the same time restrict the media overseeing appropriately, and strengthen the communication of the justice and the media to promote collaboration, restraint and trust among judges, lawyers and the media, so as to guarantee the justice and the media's harmonious and rational development. Chapter 3 analyzes the legitimacy, the real necessity and the feasibility of the media overseeing, and the theoretical foundation of the judicial restrictions on the media. Then states how the media and the judiciary should act. The author also demonstrates that the benign interaction between the justice and the media is based on the social justice. According to the specific conditions in China ,the author puts forward feasible suggestions to resolve the conflict, including changing the ideas and the institutions, improving the legal system , building the teams, and strengthening their communication. At last, the author once again stresses the importance of the judiciary and the media to the process of building democracy and the rule of law in our country. We shall find the best fit to maintain the balance between the two, in order to realize benign interaction between the justice and the media, which may push forward the process of democracy and the rule of law.
