Research On The Relationship Between Judicial Justice And Media Coverage

The relationship between judicial justice and media coverage is an important issue facing the current legal and news communities.Building a harmonious relationship between the judiciary and the media can effectively help promote and improve the socialist legal system with Chinese characteristics,and promote the formation of a fair,just and open judicial environment.Its connotation is based on judicial openness.It is a system arrangement that puts judicial power in the public eye,lets the public understand the justice,and allows judicial judgment to stand the test.The practical significance of this study is far from this.Harmonious judicial and media relations can make the judicial concept able to penetrate the hearts of the people,plant the foundation of the rule of law,establish judicial authority,and then create a rule of law atmosphere that respected,understood,and abided by the law throughout the society.The relationship between the judiciary and the media is very complicated.The judiciary can restrict the media,and the media can also supervise the judiciary,but at the same time,there is no affiliation between the two.How to find media reports and judicial justice based on maintaining common values on the balance point,how to build a harmonious relationship between the judiciary and the media,and a harmonious relationship with each other is the joint goal in all relevant fields home and abroad.The thesis starts from the value objective between the current judicial activities and media reports,sorts out the practice and development of domestic and foreign response to law-related news reports,makes preliminary explanations on typical issues,and researches on comparative theory on the basis of theory way to study some typical cases home and abroad.It discusses the general and special situations in hot cases and public opinion,analyzes the new challenges and problems in the new media environment from a development perspective,thus advocates the establishment of harmony and order of justice and media interaction.The full text consists six chapters with over 160,000 words,the main contents are as follows:First of all,it analyzes the principles of judicial justice and the characteristics of media news reports from the concept,and analyzes the legitimacy of media participation in judicial activities from the theories of the right to know,expression and supervision,compares the common value pursuit and different working methods,points out the conflicts and difficulties in handling practice.Focusing on judicial disclosure from the pre-trial and trial,this study makes public analysis of the characteristics and difficulties of media reports in different stages of intervention,in-depth analysis of the value of media reports on judicial disclosure and the conflicts in current practice,and gives preliminary discussion on the principle of exception.Through the recent hot cases in China,this study analyzes the different characteristics of the relationship between justice and the media,analyzes the role of media reports in correcting unjust,false and wrong cases like the Huge case and the Zhao zuohai case;analyzes the impact of public opinion pressure on the trial work in the Yao jiaxin case;analyzes the news public opinion in the Yu Huan case to facilitate the self-correction of the judicial system;analyzes the new opportunities and challenges of judicial work in the complex media environment in the new media era with the case of Zhang koukou.From the perspective of comparative method,this study analyzes the practices and characteristics of handling news reports and judicial relations in the United States,the United Kingdom,and continental European countries,enumerating regulations and methods in areas such as freedom of speech,open court hearings,confidentiality systems,and privacy rights,summarizing regular features,and offers implications to improve our domestic work.It makes a brief analysis of the current media technology and communication environment,and at the same time,gives a prospective prediction of the possible impact of these new technologies from the perspective of news reports.Finally,this study makes suggestions to improve the relationship between media reports and the judiciary and put forward opinions and suggestions on building a harmonious relationship between the media and the judiciary according to the previous research.
