For its own characters and the process which can't avoid the factor of"man"in exercising power process, public power produces attraction to the weakness of human nature with the dangers of leading to corruption and being abused easily. Past or present, in or out our country, many theoreticians, scholars and politicians have discussed how to check and balance of public power and got many excellent theoretical, achievements and practical effect in reality. This paper mainly discusses the way of checks and balances of public power by right.This paper is divided into four parts.First part, discuss the concepts of power and right, producing process of power and development of concepts of right in the past or present, within or out country.Second part, analysis the character of power. From the ancient Greeks, theoreticians, politicians and scholars have the conclusion that the power must be checked and balanced. In the discussing process they have many forms. We introduced three of them which being put into practice: by power, moral and right.Third part, discuss the theoretical origin and meaning of the checks and balances of power by right. Sovereign right of people in the theory of society contact. On the basis of the form, this paper discussed the theoretical meaning in practice of present society.Fourth part, analysis the different ways of checks and balances of power by right in practice, have some advice of completing the form and point out the different subjects'conduction of National Peoples Congress, administration organization, individual of citizen, news media and so on in the practice of checks and balances of power by right in our country. From the basis , discussed the reality ensurence and meanings of checks and balances of power by right.
