On Investigation Procedures For Juvenile Criminal Cases

Most developed countries have established complete investigation procedures for juvenile criminal cases which China is trying to build and strengthen. In this paper, comparative and analytical methods are applied to point out deficiencies of investigation procedures for juvenile criminal cases in China. To improve the procedures, successful relative legislative experiences abroad and special legal circumstance in our country are used for reference.The whole paper, which is about 40,000 characters long, contains four main parts with detailed introduction of each part as follows: The first part describes the intension, establishing basis and significance of investigation procedures for juvenile criminal cases. It is proposed that the establishment of investigation procedures in China is necessary for preventing juvenile delinquency becoming increasingly serious, protecting juvenile's legal rights and implementing penal policy of"Educating, reforming and saving". This accord with international criteria of juvenile justice and the requirement of China's reform of juvenile justice system, and will help control juvenile delinquency and defend juvenile's legal rights, which shows a profound and lasting magnificence on the establishment and improvement of juvenile justice system in China.The second part reviews on investigation procedures for juvenile criminal cases abroad, which introduces perceptions of juvenile justice system abroad, and comparatively explores investigation procedures for juvenile criminal cases in typical countries, include Germany, USA, Sweden and Japan. On basis of this, thoughts about investigation procedures for juvenile criminal cases abroad and measures for improvement are further explained.The third part covers current situations of investigation procedures for juvenile criminal cases in China and its basic principles and process. Evaluations and deficiencies of investigation procedures are also put forward.The fourth part mentions about five suggestions to improve investigation procedures for juvenile criminal cases in China, which mainly concerns about juvenile summons and interrogation system, system of applying coercive measures and detainment to juvenile criminal suspects, appointed defense system in juvenile criminal cases, investigation and supervision of juvenile criminal cases and the specialization of investigators in juvenile criminal cases.
