Juvenile Crime Investigation Procedures:Basic Design And Special Protection

In recent years,malignant crimes of minors in China have been reported frequently,which has aroused widespread concern at home and abroad.The new criminal procedure law of 2012 stipulates the procedure of juvenile criminal cases in the first chapter of special procedures,which positively responds to the current situation of juvenile crimes and has positive significance.However,there are few provisions on the investigation procedures of juvenile crimes,which are still under construction and improvement.This paper mainly USES investigation,case study,comparative analysis and other methods,combined with the current serious situation of juvenile delinquency in China,and finds out the problems and deficiencies in the investigation procedures of juvenile delinquency cases.It also draws lessons from foreign advanced experience,pursuit,absorbing essence,adhere to the aim of protection of minors' rights,adhere to the education is given priority to,the principle of punishment is complementary,tries to explore a conform to the current our country concrete national conditions of minor crimes investigation procedure.This paper is about 30,000 words,divided into three parts:The first part of this paper starts with the special study of the investigation of juvenile delinquency in China,analyzes the general causes of juvenile delinquency,especially expounds the reasons for the increase in the proportion at a particular age and the higher rate of crimes committed by certain categories of minors,and makes an investigation and analysis on the types of juvenile delinquency.After investigation and research,it is found that there are still many defects in the current investigation procedures of juvenile crimes in China,and there is a big gap between them and the international and foreign advanced systems,which need to be improved.The second part is the basic design of the investigation procedure of juvenile delinquency.The author based on the special Chinese underage criminal investigation,combined with the consideration of problems existing in the process,respectively from the public security and criminal investigation guide mode,the application of restorative justice,a felony accompanied with the rule of law,the cases of minors difficulty of rules of conceived system from the aspects such as basic design,highlights the concept of educationto give priority to.The third part is the process protection measures of the investigation of juvenile delinquency.Investigation is the beginning of criminal proceedings and plays a decisive role in the proceedings,and itself is a process of verifying criminal facts and arresting suspects,so the protection of the process of juvenile crime investigation is extremely important,among which the sealing of files and the protection of juvenile custody are more worthy of attention.
