Legal Research On The Non-government Organizations Of Environmental Protection Involved In Environmental Matters

Along with the constant deepening of the global environment crisis, political and the economical reforming, the Non-government Organizations of Environmental Protection (NGOEP) arises at the historic moment. As an important public institute for participating in the environmental protection, the Chinese NGOEP is unceasingly developing and expanding. At present, the research on the NGOEP has already made many progresses. However, it was mainly conducted from the angle of the organization and the administrative management, leaving the law field of vision relatively weaker. From the angle of the legal science, this article analyzes the public participation in the NGOEP with cases study.Only having clarified what the research object is can we know how the research object should be, and possibly establish an appropriate legal system for NGOEP--the research object. When discussing its definition, the article employs international theories, giving dual attention to the Chinese actual national condition, and balances persisting the principle and being flexible to explain the connotation of the NGOEP. The Chinese NGOEP's public participation to the environment matters, regardless of the breadth or the depth ,is both far inferior to the developed country NGOEP's work, partially because of the interior flaw of the organization, partially because of the different cultural context and the social structure reason. Anyway, the main reason is the imperfect legal system.To perfect present legal system of NGOEP, we must transform the original strict management, the restrictive development ideology and reduce NGOEP's registration requirements. The rights of the Organization to participate in the environment business should be raised. Its status and function should also be stressed prominently. In details, the right to know is supposed to be more sequenced and more specific. The environment decision-making should improve the procedure by public hearing to guarantee the organizations'right to speak.
